
“Contractor” refers to Makepeace Landscapes.
“Client” refers to the person, organisation, or authority instructing the works.
“Works” refers to all services, labour, and materials supplied by the Contractor.
2.1 All quotations are valid for 30 days unless stated otherwise.
2.2 Quotations are based on the information available at the time of pricing.
2.3 Any variations or additional works requested by the Client will be priced separately and agreed in writing prior to commencement where practicable.
3.1 Payment is due on completion of each item of work unless otherwise agreed in writing.
3.2 Any sums outstanding beyond 14 days may accrue interest at 4% above the Bank of England base rate, together with any reasonable recovery costs incurred.
3.3 The Contractor reserves the right to suspend works where payment terms are not met.
4.1 Any dates provided for commencement or completion are estimates only.
4.2 The Contractor shall not be held liable for delays caused by weather conditions, site access issues, third parties, or other circumstances beyond reasonable control.
4.3 Where delays occur, works will be rescheduled as soon as reasonably practicable.
5.1 The Client is responsible for ensuring safe and reasonable access to the site.
5.2 The Client shall ensure that all necessary permissions, consents, licences, and approvals are obtained prior to commencement of the works.
5.3 The Contractor accepts no liability for works carried out where such permissions have not been granted.
6.1 Where tree works are instructed, the Client confirms that no Tree Preservation Orders (TPOs), Conservation Area restrictions, or other statutory protections apply, or that the relevant permissions have been obtained.
6.2 The Contractor accepts no liability or costs arising from works instructed where permissions have not been secured by the Client.
7.1 All materials supplied by the Contractor remain the property of Makepeace Landscapes until paid for in full.
7.2 The Contractor reserves the right to remove unpaid materials where lawful to do so.
8.1 The Contractor shall carry out works with reasonable skill and care in accordance with industry standards.
8.2 Natural materials are subject to variation in colour, texture, and appearance.
8.3 No guarantee is given where works rely on existing structures, substrates, or materials supplied by others, unless expressly stated in writing.
9.1 All works will be carried out in accordance with current Health & Safety legislation and best practice.
9.2 The Contractor will take reasonable steps to protect the public, operatives, and the environment.
9.3 The Client agrees to observe any temporary restrictions or site controls required during the works.
10.1 The Contractor shall not be liable for pre-existing defects or damage to underground services not made known prior to commencement.
10.2 Liability is limited to the value of the works carried out, except where required otherwise by law.
11.1 Where works are cancelled by the Client after acceptance, the Contractor reserves the right to recover reasonable costs incurred, including labour, materials, and administration.
12.1 These Terms & Conditions are governed by the laws of England and Wales.
